We introduce a new understanding of deontic modals that we callobligations as weakest permissions. We argue for its philosophical plausibility, study its expressive power in neighborhood models, provide a complete Hilbert-style axiom system for it and show that it can be extended and applied to practical norms in decision and game theory.

We develop an exact truthmaker semantics for permission and obligation. The idea is that with every singular act, we associate a sphere of permissions and a sphere of requirements: the acts that are rendered permissible and the acts that are rendered required by the act. We propose the following clauses for permissions and obligations: -/- - a singular act is an exact truthmaker of Pφ iff every exact truthmaker of φ is in the sphere of permissibility of the act, and (...) -/- - a singular act is an exact truthmaker of Oφ iff some exact truthmaker of φ is in the sphere of requirements of the act. -/- We show that this semantics is hyperintensional, and that it can deal with some of the so-called paradoxes of deontic logic in a natural way. By building on work by Kit Fine, we develop a sound and complete truthmaker semantics for Lou Goble’s conflict tolerant deontic logic BDL.

In Meyer’s promising account [7] deontic logic is reduced to a dynamic logic. Meyer claims that with his account “we get rid of most (if not all) of the nasty paradoxes that have plagued traditional deontic logic.” But as was shown by van der Meyden in [4], Meyer’s logic also contains a paradoxical formula. In this paper we will show that another paradox can be proven, one which also effects Meyer’s “solution” to contrary to duty obligations and his logic in (...) general. (shrink)

In this contribution the socalled Meno-Problem will be discussed. With respect to theories the problem is the following question: Why is it epistemologically more valuable to know a true theory than to simply believe it? A classical answer in reabilist accounts to this problem refers to the value of the operation which is used for gathering knowledge. But there is a gap in the argumentation as far as one is not allowed to derive from this assumption the conclusion that also (...) the result of the operation is valuable. We are going to show a difference between true theories which are just believed and theories which are also known to be true. This difference seems to allow one to close the mentioned gap. (shrink)

In this comment to Kehrer (2014) the relevance of atheistic argumentation in the domain of ethics as an important part of religion is sketched.

Dieser Sammelband hat zum Ziel, moderne atheistische Richtungen kritisch und wissenschaftlich zu betrachten. Mit diesen modernen atheistischen Richtungen ist vor allem der in Oxford unterrichtende Biologe und Religionskritiker Richard Dawkins verknüpft, bekennender Gegner von Kreationismus, Intelligent Design und Theologie, der schon 1976 mit der Veröffentlichung seines Buches "Der Gotteswahn" in der breiten Öffentlichkeit auf sich aufmerksam machte. Auch in jüngerer Vergangenheit, und zwar im Jahr 2006, war Dawkins mit seinem Buch (Dawkins 2006) an einem erneuten Aufflammen einer vor allem in (...) den USA geführten Diskussion rund um die Vereinbarkeit oder Unvereinbarkeit von theologischen und evolutionstheoretischen Ansätzen beteiligt. Beim Durchblättern dieses Buches wird spätestens beim Entdecken des vierten Kapitels, das den provokanten Titel "Warum es mit ziemlicher Sicherheit keinen Gott gibt" trägt, klar, dass Dawkins damit keine Brücke zwischen Evolutionsbiologie und Schöpfungstheologie schlagen möchte. Auch Dawkins selbst hält dieses Kapitel für das wichtigste seines Buches: "This chapter has contained the central argument of my book" (cf. Dawkins 2006, p. 187). -/- Dies ist Grund genug, uns dieses Kapitel aus Dawkins' Buch näher anzusehen. Schließlich verbindet Dawkins damit hohe Ansprüche: "If the argument of this chapter is accepted, the factual premise of religion - the God Hypothesis - is untenable. God almost certainly does not exist. This is the main conclusion of the book so far" (cf. Dawkins 2006, p.189). This paper deals with the axiomatizability problem for the matrix-based logics RMQ − and RMQ *. We present a Hilbert-style axiom system for RMQ −, and a quasi-axiomatization based on it for RMQ *. We further compare these logics to different well-known modal logics, and assess its status as relevance logics.

The SOPhiA conferences are intended to give young predoctoral philosophers the possibility to actively attend a professional conference, to tackle current, as well as classical, philosophical problems, and to discuss their own approaches with promising students from many dierent countries as well as with wellestablished experts. We are firmly convinced that this is a natural and necessary step for promoting the next generation of analytic philosophers and thus, strengthening analytic philosophy in general. Because we believe that the methods of analytic (...) philosophy can be fruitfully applied to all areas of philosophy, the SOPhiA conferences do not have a thematic focus; this is also reflected by the fact that the talks given at SOPhiA 2011 covered all areas of philosophy. Here the philosopher and physicist David Z Albert argues, among other things, that the difference between past and future can be understood as a mechanical phenomenon of nature and that quantum mechanics makes it impossible to present the entirety of what can be said about the world as a narrative of “befores” and “afters.”.

This book is an attempt to get to the bottom of an acute and perennial tension between our best scientific pictures of the fundamental physical structure of the world and our everyday empirical experience of it. The trouble is about the direction of time. The situation (very briefly) is that it is a consequence of almost every one of those fundamental scientific pictures--and that it is at the same time radically at odds with our common sense--that whatever can happen can (...) just as naturally happen backwards. Charles Sanders Peirce is generally regarded as the founder of pragmatism, and one of the greatest ever American philosophers. Peirce is also widely known for his work on truth, his foundational work in mathematical logic, and an influential theory of signs, or semiotics. Abstract:Therapeutic misconception (TM)—when clinical research participants fail to adequately grasp the difference between participating in a clinical trial and receiving ordinary clinical care—has long been recognized as a significant problem in consent to clinical trials. We suggest that TM does not primarily reflect inadequate disclosure or participants’ incompetence. Instead, TM arises from divergent primary cognitive frames. The researchers’ frame places the clinical trial in the context of scientific designs for assessing intervention efficacy. In contrast, most participants have a cognitive frame (...) that is personal and focused primarily on their medical problems. To illustrate this, we draw on interview material from both clinical researchers and participants in clinical trials. We suggest that reducing TM requires encouraging subjects to adjust their frame, not just add information to their existing frame. What is necessary is ascientific reframingof participation in a clinical trial. (shrink)

This paper challenges the traditional assumption that descriptive and prescriptive sciences are essentially distinct by presenting a study on the implicit normativity of the production and presentation of biomedical scientific facts within evidence-based medicine. This interdisciplinary study serves as an illustration of the potential worth of the concept of implicit normativity for bioethics in general and for integrated empirical ethics research in particular. It demonstrates how both the production and presentation of scientific information in an evidence-based decision-support contain implicit presuppositions (...) and values, which pre-structure the moral environment of the clinical process of decision-making. As a consequence, the evidence-based decision support did not only support the clinical decision-making process; it also transformed it in a morally significant way. This phenomenon undermines the assumption within much of the literature on patient autonomy that information disclosure is a conditional requirement before patient autonomy even starts; patient autonomy is already influenced during the production and presentation of information. These results imply an increased responsibility of those who produce and present evidence-based facts(i.e. scientists in general and physicians in particular). The insights of this study not only involve a different focus on both theory and practice of patient autonomy and informed consent, but they also call for a broader scope of morality than does traditional empirical research in bioethics. The concept of implicit normativity within integrated empirical ethics research calls for a strong cooperation between bioethicists and descriptive scientists, i.e., a cooperation that goes beyond the discipline-specific epistemic values and that takes place during all phases of the research process. In this paper, I critically assess different interpretations of Bohmian mechanics that are not committed to an ontology based on the wave function being an actual physical object that inhabits configuration space. More specifically, my aim is to explore the connection between the denial of configuration space realism and another interpretive debate that is specific to Bohmian mechanics: the quantum potential versus guidance approaches. Whereas defenders of the quantum potential approach to the theory claim that Bohmian mechanics is better formulated (...) as quasi-Newtonian, via the postulation of forces proportional to acceleration; advocates of the guidance approach defend the notion that the theory is essentially first-order and incorporates some concepts akin to those of Aristotelian physics. Here I analyze whether the desideratum of an interpretation of Bohmian mechanics that is both explanatorily adequate and not committed to configuration space realism favors one of these two approaches to the theory over the other. Contrary to some recent claims in the literature, I argue that the quasi-Newtonian approach based on the idea of a quantum potential does not come out the winner. (shrink)

"Race" is so highly charged and loaded a concept it often hampers critical thinking about racial practice and policy. A philosophical approach allows us to isolate and analyse the key questions: What is race? Can we do without race? What is racism and why is it wrong? What should our policies on race and racism be? Debates over the reality of race often rely on arguments about the connection between race and science—those who deny that race is real argue that there is no significant support from science for our ordinary race concepts; those who affirm that race is real argue that our ordinary race concepts are supported by scientific findings. However, there is arguably a more fundamental concern here: How should we define race concepts in the first place? The reason I claim that this definitional (...) question is more fundamental is that our handling of the underlying definitional problem often determines the scientific support our ordinary race concepts need, and importantly the likelihood of finding such support. In short, the defini- tional question, “How do we define race?” often undercuts the question of whether race is scientifically meaningful. (shrink)

Modern Social Contract Theory provides an exposition and evaluation of major work in social contract theory from 1950 to the present. It locates the central themes of that theory in the intellectual legacy of utilitarianism, particularly the problems of defining principles of justice and of showing the grounds of moral obligation. It demonstrates how theorists responded in a novel way to the dilemmas articulated in utilitarianism, developing in their different approaches a constructivist method in ethics, a method that aimed to (...) vindicate a liberal, democratic and just political order. A distinctive feature of the book is its comparative approach. By placing the works of Barry, Buchanan and Tullock, Harsanyi, Gauthier, Grice, Rawls, and Scanlon alongside one another, similarities and differences are brought out, most notably in the way in which principles are derived by each author from the contractual construction as well as the extent to which the obligation to adopt those principles can be rationally grounded. Each theory is placed in its particular intellectual context. Special attention is paid to the contrasting theories of rationality adopted by the different authors, whether that be utility theory or a deliberative conception of rationality, with the intention of assessing how far the principles advanced can be justified by reference to the hypothetical choices of rational contracting agents. The book concludes with a discussion of some principal objections to the enterprise of contract theory, and offers its own programme for the future of that theory taking the form of the empirical method. In my paper, I develop a phenomenological and pragmatist reflection on the fragility of liberal democracy’s moral foundations in times of war. Following Judith Shklar’s conception of the “liberalism of fear”, the legitimacy of the liberal-democratic order is seen as grounded in experiences of suffering caused by political violence. It is also assumed that the liberalism of fear delivers an adequate conception of the normative foundations of the European project. With the help of phenomenologists such as Edmund Husserl, Maurice Merleau-Ponty (...) and Michel Henry, the paper ants to philosophically deepen the liberalism of fear by outlining a theory of “pathic evidence” as a normative foundation and the concept of a common “flesh of the political” as a shared moral sensitivity that sets boundaries to political conflict as well as the political imaginary, excluding what I call the production of “monumental meaning”. It then examines the question which political conditions are needed for this evidence to become a shared, communal criteria of ethical thought, and considers inner and outer challenges to the transmission and reproduction of this evidence in time, drawing especially on John Dewey’s ideas of democratic communication and social intelligence. In the current war, the following problem appears as crucial for the “soul” of European democracies which are confronted with the need to respond to Russia’s attack: How can a political morality grounded in pathic evidence be sustained, once it is challenged by an aggressor who, out of cultural and political reasons, shows a higher level of toleration towards violence? Besides aggression from an external foe, there are also temporal dynamics that further the loss of the inhibiting force of pathic evidence from the inside. As it shall be argued, boredom can be such a factor. The paper concludes by drawing conclusions for the current war in Ukraine. (shrink)

He is well-known for applying the idea of critical reason to various kinds of human practice, including economics, politics, and law. But he has also improved on Popper's methodology by introducing the idea of rational heuristics. This collection of essays presents the core of his work on epistemology, philosophy of the social sciences, philosophy of religion, and philosophy of law. An edition of two manuscript essays found in the family archives of the descendants of the painter and writer Eugène Fromentin. These unpublished essays were submitted in 1840 by their author, Albert Aubert, to Fromentin and his friend Paul Bataillard, for comment and in part response to a question which they had posed, concerning the importance of ambition as a prerequisite for happiness. Les deux essais, publiés ici pour la première fois, datent de mars 1840. Leur auteur, Albert (...) Aubert, y répond, au moins partiellement, à une question que ses amis, Eugène Fromentin et Paul Bataillard, lui avaient posée : pour être heureux, l'homme doit-il avoir de l'ambition? Abstract‘Assisted dying’ (an umbrella term for euthanasia and/or assisted suicide) is frequently defended as an act of autonomous self-determination in death but, given a choice, between 93.3% and 100% of patients are reluctant to self-administer (median 99.5%). If required to self-administer, fewer patients request assisted death and, of these, a sizable proportion do not self-administer but die of natural causes. This manifest avoidance runs counter to the concept of autonomous self-determination, even on the supposition that suicide could truly be autonomous. (...) The avoidance of self-administration does not show that self-administration, when it occurs, is necessarily autonomous. It suggests, rather, that there are other frames by which assisted dying is being understood. One such is desire for medical control, a desire shared by patients and doctors. Such a frame is not directed towards an exacting autonomy (self-directed action by the patient) but towards a comforting heteronomy (letting the doctor take control). (shrink)
